Contract Law The law of obligations is one of the primary branches of private law. It governs contracts bringing together the desires of two or more parties with a view to creating legal effects. There are many examples of real estate contracts in which each co-contractor undertakes commitments with regard the others. The respect of the contractual engagements is based on the principle of autonomy of will. Each party is only bound as a result of their own free will, which is the principle of freedom of contract. The study of contract law means mastering the legal foundations of all real estate transactions.

Property Law Property law is at the heart of the French legal arsenal. Real estate ownership can take various forms: property division, usufruct, joint ownership, easements, etc. It can even be exercised through a legal entity: the SCI. Ownership can be obtained the standard way through acquisition but also through purchase, possession or inheritance. These are all basic concepts that real estate professionals must master. Real Estate Disputes The field of real estate is often the scene of numerous disputes between owners and tenants, between co-owners, between residents and developers, between neighbours... Through a cross-discipline approach, this module enables students to understand the different procedures and protect against risks relating to: - rent collection - neighbourhood disturbances - disputes at the time of lease termination - failure to pay in the case of co-ownership - failure to pay at the time of sale, sale agreements - failure to pay in the case of real estate intermediaries Langue de l'enseignementFRANÇAIS / FRENCH | 8h | 16h
Real Estate Taxation Taxation is the necessary corollary of any real estate operation, whether it concerns transaction, management or development. It is not possible to consider a real estate investment without taking account of the associated taxation. Property acquisition is subject either to transfer duties or free transfer rights. Income tax and industrial and commercial revenue are also associated with the management of the property. Possession entails the payment of local taxes, various ancillary taxes and property tax. With regards resale, it may lead to capital gains or losses on real estate. Several of the operations mentioned are also concerned by VAT.

UE3 Real Estate Management | 11
Commercial Lease The main legal tool for commercial real estate is the commercial lease; other tools include the professional lease, derogatory lease, precarious occupation agreements and leases under the Civil Code. Students must learn which situations each one should or can be used in. Moreover, unlike residential leases, where the regulations do not allow the parties to negotiate the terms of the contract, these leases offer both a great deal of freedom for negotiation and at the same time, in some cases, impose a large amount of rigidity. It is important to master these subtleties in order to properly advise clients or decision-makers, especially since significant financial stakes are often involved. Co-Ownership Co-ownership is a situation in which a building belongs to several people each with their own separate property. The building is therefore divided into common areas and private areas. A large number of buildings are co-ownership buildings. The law and co-ownership regulations set the rules for living together. It is essential for trustees to understand and master the workings of this situation in order to manage the building with regards the technical, financial and administrative aspects, etc. without risking liability. It is also important for the managers of properties located in such buildings, investors who wish to optimise their investment and developers who are preparing the co-ownership arrangement, to be aware of all the subtleties, especially in the case of majority decision-making, as well as the reasoning behind works and the distribution of costs.

Comparative Management of Social and Open-Market Housing There are approximately 11,000,000 primary residences in France, of which some 4,800,000 are social housing. There are various legal regimes between "private" sector and social housing, often referred to as "intermediate housing". It is of course essential to understand the specificities of social housing management compared to the private sector for those wishing to work in a HLM organisation, but it is also important for those working in the private sector. This is because there is an increasing number of intermediate systems which can also be opportunities for lessor clients; these systems adopt characteristics of social housing that private managers will find difficult to understand if they are not familiar with the specificities of social housing. Real Estate Accounting Real estate accounting is a very specific field due to the nature of the expenses and products. A rental accountant is responsible for managing the payment of rent and the allocation of bills. A co-ownership accountant ensures that the co-owners pay their fees and is responsible for alerting the manager to financial risks. He works in cooperation with the co-ownership manager or trustee. Budget planning and variance control are also part of the responsibilities of rental or co-ownership accountants. The skills to be acquired cover: - receipts, calls for funds from tenants or co-owners - monitoring of invoices, breakdown of charges - balance sheets and payments to suppliers - bank reconciliation and making entries - customer relations (tenants or owners) - payroll management for building staff Langue de l'enseignementFRANÇAIS / FRENCH | 11h | 22h

Construction and Urban Planning Law In France, the Plan Local d’Urbanisme (PLU, PLUi) is the main urban planning document. Based on a detailed diagnosis of all the components of a local area, it defines the major objectives and the main guidelines for development, as well as the rules governing building permission and land use to meet this end. In addition to its regulatory nature, it is also a project document for the area it covers. It defines a medium and long-term local strategy. Multiple regulatory changes have reformed and added to the content of the PLU. The course will continue with a focus on taking account of the specificities of urban planning in the area surrounding Meaux. Langue de l'enseignementFRANÇAIS / FRENCH | 11h | 23h
